User rights agreement KWIN

By registering for the digital KWIN and/or using the digital KWIN, you agree to the terms and conditions set out below:

Article 1. Definitions

1. 'Livestock Research': DLO Foundation, Wageningen Livestock Research in Lelystad
2. 'Plant Research': Plant Research Foundation in Wageningen
3. 'Subscriber': The natural or legal person who has or wishes to have access to the digital KWIN.
4. The subscriber is not entitled to transfer the rights and obligations arising from this agrrement to third parties in any way, unless Livestock Research or Plant Research has given its express writtten consent. 

Article 2. Subscription business model

1. The subscriber declares to be aware of, and agree to, the terms and conditions as formulated in these General Delivery Terms.  
2. The subscriber is entitled to use the created login data to access KWIN and/or  the registered calculation modules for 1 year from the time of puchase or renewal. The subscriber is entitled to use the purchased PDF KWIN Green Horticulture under his/her own name (corresponding to his/her e-mail address in the watermark) without an expiration date.
3. The subscriber is not entitled to share the login data with third parties. Use of personal login data by third parties will automatically and with no prior notice, lead to denial of access to KWIN and/or the calculation modules. The subscriber is not entitled to copy the PDF nor share it with others.
4. The subsciber with a single license has no right or ability to simultaneously access KWIN or Guide through multiple terminals and/or computers.
5. If it involves a (company) subscription and a PDF has been made available with the company name, it must remain within the company/organisation and may not be shared with third parties.

Article 3. Copyright

1. Wageningen Livestock Research and Wageningen Plant Research are and shall remain the legal owners of all information contained in the KWIN and Guides and as such shall retain all copyrights and other proprietary rights to the KWIN and Guides and all information contained therin.
2. If the subscriber acts in violation of the provisions of Article 2.3, 2.4, 2.5 and/or Article 3.1, access to the KWIN and Guides will be automtically denied. Reimbursement of paid subscription fees is hereby excluded.

Article 4. Subscription period

1. The subscription period for the KWIN for livestock is on a yearly basis.
2. Upon conclusion of the subscription, the subscriber pays directly or via invoice for the first subscription year. 1 month before the subscription period ends, the subscriber will receive a reminder and can choose to renew or not.

Article 5. Liability

1. Notwithstanding any provisions of this user agreement, any and all liability on the part of Wageningen Livestock Research and Plant Research with respert to the provision of the KWIN and the Guides, their content or the consequences of their use is excluded. 

This user rights agreement is governed by Dutch law.
